I. Introduction

eCharge recognizes the importance of respecting the privacy of our subscribers. Accordingly, we want you to understand how personal information about you may be used or disclosed and, the choices we provide you to request that your information be updated or corrected or not released.

eCharge also recognizes the need for security on the Internet, which is why we have Internet security standards and procedures in place to protect against unauthorized disclosure of information or access to information about you from our Web site. In addition, we limit employee access to personally identifiable information about you to those employees who have a business purpose for access to such information.

II. Does eCharge collect Personal Information?

Yes, eCharge and providers of eCharge products and services through this Site ("Providers") obtain information in several ways, described below:

1. Visiting eCharge on the Web

When you connect with our Web site, we may gather information about your visit, but not about you personally. This information is collected on an aggregate basis. No personal information is associated with the statistics. For example, while we can determine that on a specific day the site had thousands of visitors, we do not know anything about those visitors in terms of e-mail address or any other personal data.

Different technologies are used to collect aggregate statistics, including web server logs and cookies. Web server logs tell which pages are more and less popular in our site. A cookie is a small piece of information that a Web site stores on your Web browser on your PC and can later retrieve. The cookie cannot be read by a Web site other than the one that set the cookie. We use cookies for a number of administrative purposes; for example, to store your preferences for certain kinds of information. Most cookies last only through a single session, or visit to our site. 2. eCharge Net Account

In the event you wish to apply for an eCharge Net Account and take advantage of the products and services offered by eCharge and other persons providing services through the eCharge Web site, you will be required to become an eCharge subscriber. If you apply for the credit eCharge Net Account, your application information will be provided to Washington Mutual Bank, FA ("WAMU"). The application contains personal information, such as your name, email address, phone number, social security number, and other similar information needed to identify and serve you. This information, as well as information obtained from credit bureaus, is necessary to evaluate your credit application. The information about your credit eCharge Net Account transactions will also be provided to WAMU.

If you apply for the prepay eCharge Net Account, your application information will be provided to eCharge Bank. The application contains personal information, such as your name, email address, phone number, social security number, and other similar information needed to identify and serve you. The information about your prepay eCharge Net Account transactions will also be provided to eCharge Bank.

3. Communications with eCharge

eCharge and the Providers may keep track of when and why you write us or speak to us regarding your experience with eCharge products and services and this Site, such as questions about your account, or issues about goods and services provided in conjunction with eCharge. This allows you to receive consistent, quality service.

4. Promotional Offers

Throughout the eCharge site, you have the opportunity to send e-mails, request information, enter contests and respond to various promotions. If you choose to participate in any of these activities, you will be providing eCharge with some type of personal information about yourself.

5. Voluntary Customer Surveys

eCharge may periodically conduct individual voluntary customer surveys. We encourage our customers to participate in these surveys because they provide us with important information that helps us to improve the types of services we offer, and how we provide them to you.

6. Children

eCharge and the Providers do not knowingly solicit data from children under 13 years old. Furthermore, we do not knowingly market our products and services to children under 13 years old.

III. How Is Personal Information Used?

eCharge, the Providers (including eCharge Bank and WAMU), and participating merchants may use and share personal information in different ways, such as:

  • To provide users with the highest level of service and to protect against the fraudulent or improper use of the eCharge products and services.

  • To provide information as is necessary to fulfill the fundamental purpose of our products and services, including providing certain information to third party service providers in connection with transactions using the eCharge products and services.

  • To identify users of eCharge products and services that may be interested in offers of goods and services that are suited to their needs and interests, both from eCharge and from other parties.

  • To provide notice of additional services or programs run by eCharge or our marketing partners with information practices unique to that program. In every event, we will inform you of the information practices unique to that program before you choose to participate.

  • In response to a lawful request issued by a court, government agency, or regulatory authority with jurisdiction to make the request or to otherwise comply with legal requirements.

  • To companies that work for eCharge or others providing services through this Site, such as printing and data processing companies. These companies are required to keep the information provided to them confidential.

  • To affiliates in order to serve you. Personal information (other than experience or non-identifying information) will not be shared with affiliates unless you receive prior notice and you have not exercised your right to be excluded from such sharing.

IV. Do I have to get Offers of Goods and Services from eCharge or Other Companies?

No, eCharge lets you decide whether or not to receive new offers of goods and services. eCharge Net Account customers are offered the opportunity to receive special offers from eCharge, on-line retailers and other companies as part of the application process. These special offers may include specials offered by on-line retailers or new products and services offered by eCharge. Customers may chose not to receive any of these offers from eCharge, on-line retailer or other companies. If you prefer, you may choose not to receive the offers of goods and services that we make available to our subscribers by sending an e-mail to technical@echarge.com. Please include your first and last name, email address, and home address. Due to the time involved in processing these requests, there is a possibility that you will briefly continue to receive such offers after opting out.

V. What If I Have a Question or Problem?

eCharge is committed to preserving the privacy of our subscribers. We have described the manner in which we collect and use personal information. We provide you with a choice regarding our use of personal information. In the event you have concerns, questions or a problem arising out of our performance pursuant to this policy, it should be directed to us by email at technical@echarge.com.
